Terms of Service

1. Agreement to Terms
By accessing or using the NordenVault platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. We will notify you of material changes by email or through the dashboard at least 30 days before they take effect.
2. Description of Service
NordenVault provides S3-compatible object storage infrastructure for backup purposes, along with a web-based dashboard for managing backup sources, credentials, monitoring, and team access. The Service includes storage, data transfer, and API access as described in the plan selected by the customer.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately if you become aware of any unauthorised use of your account or any other breach of security. We are not liable for any loss arising from unauthorised use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any purpose other than backup and data storage as intended by the platform.
- Store content that is illegal, infringing, or violates the rights of others.
- Attempt to gain unauthorised access to other users' data, the Service infrastructure, or any connected systems.
- Use the Service in a manner that could disable, overburden, or impair the Service or interfere with other users' access.
- Resell or redistribute access to the Service without our prior written consent.
5. Data Ownership and Privacy
You retain all ownership rights to the data you store using the Service ("Customer Data"). We do not claim ownership of your data. We access Customer Data only as necessary to provide the Service and as described in our Privacy Policy.
We act as a data processor under GDPR with respect to Customer Data. A Data Processing Agreement is available upon request and is included for Business plan customers.
6. Service Levels and Availability
We strive to maintain high availability of the Service. Business plan customers are covered by a Service Level Agreement (SLA) with a 99.95% uptime guarantee. Details of the SLA, including credit provisions for downtime, are provided separately.
We may perform scheduled maintenance with at least 48 hours' notice. Emergency maintenance may be performed with shorter notice when necessary to protect the integrity of the Service.
7. Pricing and Payment
Fees for the Service are as described on our pricing page at the time of purchase. We may change pricing with at least 30 days' notice. Price changes do not apply to the current billing period.
Payment is due at the start of each billing period. If payment fails, we will attempt to collect payment for up to 14 days. If payment cannot be collected, we may suspend access to the Service. Data will be retained for a minimum of 30 days after suspension to allow you to recover your data.
8. Cancellation and Data Deletion
You may cancel your account at any time from the dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Upon cancellation, your data will be retained for 30 days to allow you to download it. After the retention period, data will be permanently deleted from our systems. This process is irreversible.
9. Limitation of Liability
To the maximum extent permitted by applicable law, NordenVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the Service.
Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve months preceding the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Oslo, Norway.
